    In typical postmodernity�s digital culture, new media and the Internet extend the reach of freedom of expression that is directly related to openness and access propitiated the right to information and communication, to the extent that enhance technological processes of scanning, new media and the Internet raise new level of evolution of sociality and the construction of democracy. In this context, it is necessary to identify how the principle owner may interfere with the expansion of the right of information and communication and, therefore, impact on freedom of expression in digital culture. On three separate but complementary, attempts to identify the dialectic that underlies the processes of social evolution in the digital culture of the postmodern society, in the beginning, we discuss the gaps and bottlenecks resulting of the digital culture, then back- if to the paradoxes in the construction of the right to information and communication and its relation to freedom of expression in the end, try to situate the relationship between property rights and right to information and communication.

    Na cultura digital típica da pós-modernidade as novas mídias e a Internet ampliam o alcance do exercício da liberdade de expressão que está diretamente relacionado à abertura e ao acesso propiciados pelo direito à informação e à comunicação; na medida em que ampliam processos tecnológicos de digitalização, as novas mídias e a Internet elevam a novo patamar de evolução a construção da socialidade e da democracia. Nesse contexto, é necessário identificar o modo como o princípio proprietário pode interferir na ampliação do acesso ao direito à informação e à comunicação e, com isso, repercutir no exercício da liberdade de expressão na cultura digital. Em três momentos distintos, mas complementares, tenta-se identificar a dialética que subjaz aos processos de evolução social na cultura digital da sociedade pós-moderna; no início, discute-se as aberturas e os impasses propiciados pela cultura digital; depois, volta-se para os paradoxos na construção do direito à informação e à comunicação e sua relação com a liberdade de expressão; no fim, procura-se situar a relação entre direito de propriedade e direito à informação e à comunicação.
