Este artigo tem como propósito uma análise da constitucionalidade do indulto individual, especialmente quando sua concessão atende a interesses particulares do Chefe do Executivo. Para isso, é empreendida uma investigação sobre os aspectos históricos e evolutivos desse instituto, bem como o exame dos requisitos legais que regem sua concessão no ordenamento jurídico brasileiro. A metodologia se baseia em uma revisão bibliográfica, e a abordagem segue um método dedutivo, enquanto o procedimento é descritivo, estabelecendo correlações entre a literatura e a caso Daniel Silveira, elencado para exemplificar a possibilidade de declaração de inconstitucionalidade quando o indulto individual desvia de sua finalidade precípua. Conclui-se que embora se trate de um ato discricionário do Chefe do Executivo, o indulto individual não pode ser concedido de forma arbitrária, para atender a interesses pessoais do Presidente da República, já que tal prática vai de encontro aos princípios da moralidade e impessoalidade. O Supremo Tribunal Federal corroborou taltese ao declarar, no julgamento das Arguições de Descumprimento Fundamental nºs 964, 965, 966 e 967, a inconstitucionalidade do decreto que concedeu indulto ao ex-Deputado Federal Daniel Silveira pelo então Presidente da República, Jair Messias Bolsonaro.
This article aims to analyze the constitutionality of individual pardon, especially when its granting serves the personal interests of the Chief Executive. For this purpose, an investigation is undertaken on the historical and evolutionary aspects of this institute, as well as an examination of the legal requirements governing its granting in the brazilian legal system. The methodology is based on a literature review, with a deductive approach and a descriptive procedure, establishing correlations between the literature and the case of Daniel Silveira, listed to exemplify the possibility of declaring unconstitutionality when individual pardon deviates from its primary purpose. It is concluded that although it is a discretionary act of the Chief Executive, individual pardon cannot be granted arbitrarily to serve the personal interests of the President of the Republic, as such a practice goes against the principles of morality and impartiality. The Federal Supreme Court corroborated this thesis by declaring, in the judgment of the Precepts of Fundamental Disobedience nos. 964, 965,966, and 967, the unconstitutionality of the decree that granted pardon to the former Federal Deputy, Daniel Silveira, by the then President of the Republic, Jair Messias Bolsonaro.
