We aim to reflect on the utopian nature of a norm of the legal-tax system, art. 38th, no. 2 of the LGT which enshrines the General Anti-Abuse Clause, based on the analysis and understanding of Tomas Morus' Utopia. Having observed the organization of the Utopia community, where the individual is governed by the pursuit of the common good, where each individual seeks to live with respect for the happiness of others, we will move on to the current community, where individualism prevails over the idea of community, well-being on the other hand, it is not part of the concerns of the individual who is guided by the perspective of having more than being. It is important to understand how individual good is conceived and what place it has in the whole.Reflecting on the utopian nature of the tax standard (CGAA), the tax payment horizon, by subjects, according to their contributory capacity, will be the objective to be achieved. Our objective is to understand whether this norm, characterized by openness and dynamism, is a utopian norm, what its objectives are, aiming at what horizon, to what extent it leads towards perfection, the imagined reality, assuming the responsibility of realizing the imagined, the utopia contained in the norm, without forgetting that, in thelegislative utopia, the evolution of society's values is assumed as the horizon to be achieved.
