    Artificial Intelligence (AI) is rapidly transforming the world, and Portugal is no exception. With the increase in autonomy of AI systems, there arises the need for appropriate regulation. Quid Iuris, if an autonomous car causes an accident, who will be held responsible? The car manufacturer? The software programmer? The car owner? Using the deductive method, it was concluded that the existing legislation on software could be applied analogously to assign ownership of the AI to the creator or the company that hired them; the possibility of applying indirect user responsibility in certain cases, and the general clause of strict liability for the risk created in most cases, with the caveat that specific regulation for the topic will be necessary. It is essential that there is clear and comprehensive legislation that addresses these issues, which should be developed in collaboration with AI experts, lawmakers, and other relevant stakeholders; it should be flexible enough to adapt to the rapid changes in AI technology, ensuring that the benefits of this technology can be safely and ethically leveraged, protecting the rights and interests of all involved.

    A inteligência artificial (IA) está a transformar rapidamente o mundo, e Portugal não é exceção. Com o aumento da autonomia dos sistemas de IA, surge a necessidade de uma regulamentação adequada. QuidIuris,se um carro autónomo causar um acidente, quem será responsabilizado? O fabricante do carro? O programador do software?O proprietário do carro? A partir do método dedutivo foi possível concluir pela aplicação análoga da legislação existente em matéria de software, para atribuir a titularidade pela IA ao criador ou à empresa que o contratou; pela possibilidade da aplicação da responsabilidade indireta do usuário em determinados casos, e da cláusula geral da responsabilidade objetiva pelo risco criado na maior parte dos casos, com a ressalva de que uma regulação específica para o tema será necessária. É essencial que haja uma legislação clara e abrangente que aborde estas questões, que deve ser desenvolvida em colaboração com especialistas em IA, legisladores, e outros stakeholdersrelevantes; deve ser flexível o suficiente para se adaptar às rápidas mudanças na tecnologia de IA, garantindo que os benefícios desta tecnologia possam ser aproveitados de forma segura e ética, protegendo os direitos e interesses de todos os envolvidos.
