    The present paper aims the understanding and analisys, under the perspective of Human and Fundamental Rights, of the armed conflicts in the Midddle East, specifically between the State of Israel and the terrorist group Hamas, focusing three fronts for this, being the humanitarian perspective, in the form of the mentioned rights, historical, for the comprehension of the origins of those relations, and at last the political-philosophical, once these situations have a great political content, mainly if modernity is observed, where the conflict is at. For that, it will be used extensive interdisciplinary bibliography, from classic authors about Human Rights and Constitutional Law, to schools of thought of Hannah Arendt and Friedrich Nietzsche, on questions about morality and politization in the core of the discussion.

    O presente artigo visa o entendimento e análise, sob a perspectiva dos Direitos Humanos e Fundamentais, dos conflitos armados no Oriente Médio, mais especificamente entre o Estado de Israel e o grupo terrorista Hamas, focando-se três frontes para a mesma,sendo a perspectiva humanitária, na forma dos já mencionados direitos, histórica, para a compreensão das origens de tais relações, e por fim político-filosóficas, vide que tais situações possuem grande teor político, principalmente ao se observar amodernidade em que o mesmo se encontra. Para tal, utilizar-se-á extensa bibliografia interdisciplinar, desde autores clássicos de Direitos Humanos e Direito Constitucional, até mesmo correntes remetentes a Hannah Arendt e Friedrich Nietzsche, em questionamentos sobre a moralidade e politização do cerne da presente discussão.
