    This article aims to analyze the challenges of implementing a Rule of Law in the international context and the implications of these challenges in the context of war. The main hypothesis of the work is that the absence of power limitations due to challenges is directly reflected in war contexts. It is assumed that when the feeling of impunity permeates the global context, it will gradually lead to war crimes. In this sense, intend to answer the following questions: what are the challenges for implementing a global Rule of Law? What are the consequences of the incipient construction of responsibilities at a global level in contexts of war? Based on the work of Gerard J. Postema, the challenges of undertaking a global Rule of Law are analyzed. With Craig Jones' interview, the implications of the law in the context of war are analyzed. It was concluded that the difficulties of global governance through law are related to thelimit of jurisdiction of international courts, a position of power to which the current global hyperpower has reached, among others. The gap in accountability at a global level not only spreads a feeling of impunity, but creates fertile ground in conflictzones for using the law as a tool to legitimize interests.".

    Este artigo tem como pretensão analisar os desafios do empreendimento de um Rule of Law no contexto internacional e as implicações destes desafios no contexto de guerra. Nesse sentido, pretende-se responder às seguintes indagações: quais os desafios para a implementação de um Rule of Law global? Quais os reflexos da construção incipiente de responsabilizações a nível global em contextos de guerra? O trabalho tem como proposição que a ausência de limitação do poder em razão dos desafios reflete diretamente em contextos de guerra. Presume-se que quando a sensação de impunidade permeia o contexto global de forma gradual ela chegará nos crimes de guerra. A partir da obra de Gerard J. Postema analisa-se os desafios do empreendimento de um Rule of Law global. Já com a entrevista de Craig Jones analisa-se as implicações da lei em contexto de guerra. Concluiu-se que as dificuldades de uma governança global por meio da lei estão relacionadas com o limite de jurisdição dos tribunais internacionais, posição de poder ao qual chegou a hiperpotência mundial atual, dentre outros. A lacuna na prestação de contas a nível planetário não apenas espalha sensação de impunidade, mas cria um terreno fértil em zonas de conflito para que se utilize da lei como ferramenta para legitimação de interesses.
