    This research aimed to analyze delegative democracy in Latin America and its applicability to the Brazilian context, in light of the Rule of Law theory. The objective was to verify whether the premises of delegative democracy are effectively found in the national historical-political reality, especially considering the recent rise of the Judiciary branch, and how the configuration of this type of democratic regime impacted the country's institutional arrangements. The guiding hypothesis of this study, which was partially confirmed in the end, is that Brazil is historically characterized as a delegative democracy, thereby avoiding the application of the Rule of Law theory due to the relationship established among the three powers in this context. Methodologically, the research was based on a bibliographical review, and the theoretical framework was specifically composed by Danilo Zolo, Brian Tamanaha, and Jeremy Waldron for the Rule of Law theory; Guillermo O'donell for discussions related to delegative democracy; and Thomas Hobbes and Pietro Costa for general aspects concerning the concepts of representation and sovereignty.

    A presente pesquisa teve por objetivo analisar a democracia delegativa na América Latina e a sua aplicabilidade ao contexto brasileiro, à luz da teoria do Estado de Direito. Pretendeu-se, assim, verificar se as premissas da democracia delegativa são efetivamente encontradas na realidade histórico-política nacional, sobretudo considerando a recente ascensão do Poder Judiciário, e, ainda, de que maneira a configuração desse tipo de regime democrático impactou nos arranjos institucionais do país. A hipótese norteadora do presente trabalho, a qual veio a ser parcialmente confirmada ao final, é a de que o Brasil se caracteriza historicamente como uma democracia delegativa, afastando a incidência dos pressupostos da teoria do Estado de Direito, tendo em vista a relação que se estabelece entre os três poderes nesse contexto. Sob o aspecto metodológico, o trabalho pautou-se em revisão bibliográfica e o marco teórico foi composto, especialmente, por Danilo Zolo, Brian Tamanaha e Jeremy Waldron, quanto à teoriado Estado de Direito, Guillermo O’donell, quanto às discussões atinentes à democracia delegativa, e Thomas Hobbes e Pietro Costa, quanto à aspectos gerais referentes aos conceitos de representação e soberania.
