    • The National Council of the Judiciary in Poland is an important element of the system of appointing judges to all judicial positions. In 2017, there was a reform of the way the members of the Council are elected in Poland, which has caused some controversy. It follows from the case law of the European Tribunals that the current form of the Council contradicts the European standard of the right to a tribunal established by law -in the context of judges obtaining positions with the participation of this Council. The aim of this article is to present this problem and to take a legal and comparative view of the functioning of judicial councils in other European countries, together with the possible consequences for these countries, using the example of the National Council of the Judicary in Poland.
