Since voluntary consumer arbitration is a reality in the European Union and about which much has been debated and written in the legal doctrine, the present work makes a brief reflection on several aspects, including the legal nature of the institute of voluntary consumer arbitration in the Portuguese legal system, in the light of the two fundamental diplomas currently in this field in force.Because the arbitration under analysis here is carried out through arbitral tribunals assigned to alternative dispute resolution centers, it is also intended to reflect on the nature of such courts, their competences and what serves as their basis –the arbitration agreement. As far as this convention is concerned, a brief reflection is made on its legal nature, manner and form of conclusion.Questions are raised, in particular, in the field of potestative arbitration, a recent reality in this field of arbitration, and to which we seek to provide answers. What is the basis for this new reality of arbitration? Is it also an arbitration agreement? Finally, and due to this new reality, the intervention of third parties in the arbitration process is addressed, namely the ways in which this may occur.

É também uma convenção arbitral?Por último e devido a esta nova realidade, é abordada a intervenção de terceiros no processo arbitral, nomeadamente os moldes em que tal poderá ocorrer.
