    The present work aims to draw initial lines in order to investigate the relationship between the tragedy of the commons and the problem of social cost, discussing, in an analytical way, the doctrine on the points mentioned based on the existing bibliography.On the one hand, there is the theory of the tragedy of the commons, which, in a nutshell, deals with how the management of common resources should occur in a given community, and the tragedy that will occur if there is mismanagement of these resources. On the other hand, there is the problem of social cost which, also in a few words, addresses extrajudicial forms of self-composition and conflict resolution, without state intervention, to avoid negative externalities, arguing that market agents move naturally in the search maximizing your objectives. Both theories refer to Law, the State, and how citizens relate to each other and to the State itself, impacting social welfare policies that were established notably in the period after World War II, and which impacted the social contract and the idea of democracy, a fact that is intended to be demonstrated in the following lines. Far from intending to exhaust the analysis of the topic studied, this writing aims to encourage debate on the proposed topic.

    O presente trabalho tem como objetivo traçar linhas iniciais no sentido de averiguar a relação entre a tragédia dos comuns e o problema do custo social, discorrendo, de forma analítica, a doutrina sobre os pontos mencionados com base na bibliografia existente.De um lado tem-se a teoria da tragédia dos comuns, que, em poucas palavras, trata de como deverá ocorrer a gestão de recursos comuns em determinada comunidade, e da tragédia que ocorrerá caso haja má-gestão desses recursos. De outro lado tem-se o problema do custo social que, também em poucas palavras, aborda formas extrajudiciais de autocomposição e resolução de conflitos, sem a intervenção estatal, para evitar as externalidades negativas, argumentando que os agentes do mercado se movem naturalmente na busca da maximização de seus objetivos.Ambas as teorias se referem ao Direito, ao Estado, e a como os cidadãos relacionam-se entre si e com o próprio Estado, impactando nas políticas de bem-estar social que foram instauradas notadamente no período posterior a Segunda Grande Guerra, e que impactaram o contrato social e a ideia de democracia, fato que se pretende demonstrar nas linhas adiante. Longe de pretender exaurir a análise da temática estudada, este escrito tem por objetivo fomentar o debate sobre a temática proposta.
