833 do CPC.

This article investigated the possibility of removing the protection of the family home in the face of a potential conflict with the effectiveness of the execution procedure. We analyzed the jurisprudence of the STJ in similar situations, comparing the strict protection of the family home under Law 8.009/1990 with the relaxation of salary non-seizability under Article 833 of the CPC. We concluded that, although we cannot adopt the premise of absolute non-seizability of the family home, we also disagree with the relaxation of protection based on an abstract conflict of principles. Overcoming rules must be judicious, considering legal certainty and the impact of the decision. Therefore, applying the precedent of salary seizure to the family home is not appropriate. The analysis must be specific and contextual, avoiding a loss of normativity and ensuring the protection of fundamental values.
