The present paper analyses the preservation of legal separation procedures in Brazilian law. After the Constitutional Amendment to the Brazilian Constitution N. 66/2010, which made possible to divorce with no previous legal separation, there have been doubts in terms of legal doctrine and judgements on whether legal separation procedures were still viable, as a mean for couples who did not seek to divorce. In 2017, the Brazilian Superior Court of Justice (STJ) ruled in the sense that legal separation, albeit no longer established in the Constitution, still exists and is preserved both in the Brazilian Civil Code and the Civil Procedure Code of 2015. Such legal debate has now been brought to the Brazilian Supreme Court (STF) by means of an exceptional appeal and the ruling of such shall be applied to all similar cases in lower courts. In this sense, based mainly on inductive reasoning over relevant legal literature, as well as comparative reasoning, the paper argues that legal separation is preserved in the Brazilian legal framework and fully compatible with the Brazilian Constitution, which has merely left the regulation of the matter to ordinary law, but not abolished it. As indicated throughout the paper, the preservation of legal separation procedures in Brazil law is important in the sense it grants more freedom for those who either do not wish or are unable to divorce. In light of such aim, the paper shall seek to demonstrate the misleading aspect of arguments in favor of the extinction of legal separation in Brazilian law.
