La persona que trabaja por cuenta ajena tiene derecho a reducir su jornada diaria de trabajo por guarda legal de un menor de doce años de edad (art. 37.6.párrafo 1º Estatuto de los Trabajadores). Este trabajo analiza el impacto de dicha reducción de jornada en la cuantía de la retribución, en el cálculo de las prestaciones económicas de la Seguridad Social y en la economía familiar. El estudio pone de manifiesto la conveniencia de revisar las disposiciones legales (estatales, autonómicas y locales) y los convenios colectivos que regulan medidas dirigidas a amortiguar el impacto económico negativo de la reducción de jornada por guarda legal. Las medidas en cuestión se articulan actualmente vía prestaciones de Seguridad Social, mejoras previstas en convenio colectivo, subvenciones autonómicas y locales y deducciones fiscales. El objetivo último es garantizar “la protección social, económica y jurídica de la familia” (artículo 39.1 Constitución Española).
Any employed person has the right, as a legal guardian, to reduce their working hours to take care of a child under the age of twelve. The objective of this paper is to analyse the impact of this reduction in remuneration as well as the resultant calculation of social security benefits and implications for the wider family.The research here demonstrates the need to review the various state, provincial and local laws as well as the collective agreements that are designed to cushion the negative economic impact of reduced working hours for legal guardianship.These measures currently include social security benefits, improved collective agreement conditions, local and regional grants and tax reductions.The ultimate goal being to guarantee the social, economic and legal protection of the family (Article 39.1 Spanish Constitution).
