    Based on the Digesto-Institutas compiled by Paulo, the historical analysis demonstrates the existence of Title XXIV of the Third book which is about lease. He also grants other rights and duties. For the research the paragraphs 5 and 6 (I., 3, 24, 5). This rules still in force today in Brazilian legislation: such as the loss of the thing in the face of an act of God does not imply the duty to repair and the death of the lessee and the continuity of the legal transaction with the successors.

    A análise histórica, tendo por base o Digesto-Institutas compendiado por Paulo, demonstra a existência do Título XXIV do Livro terceiro sobre arrendamento. Para a pesquisa destacam-se os parágrafos 5.º e 6.º (I., 3, 24, 5) dos quais se podem extrair regras ainda vigentes nos dias atuais na legislação do Brasil: como a perda da coisa em face de caso fortuito não implica o dever de reparar e a morte do arrendatário e a continuidade do negócio jurídico com os sucessores.
