Las construcciones extralimitadas: análisis doctrinal y jurisprudencial

    En el presente trabajo se analiza la situación originada por el silencio del Código Civil español en materia de construcciones extralimitadas. Como consecuencia de esta falta de regulación, han tenido que ser la doctrina y –particularmente– la jurisprudencia las que han tenido que abordar el supuesto de hecho tratando de ofrecer una solución al particular. La teoría de la accesión invertida, que es la solución casi unánime aceptada por la jurisprudencia y por la mayor parte de los autores, trata de integrar la laguna legal existente en la materia. El desarrollo, el análisis sistemático de los postulados de esta teoría y las consecuencias jurídicas de su aplicación constituyen el grueso de la exposición. Juntamente con esta teoría, se propone como alternativa la doctrina de la accesión horizontal, que será estudiada en sus aspectos más esenciales.

    This paper analyzes the situation caused by the silence of the Spanish Civil Code in terms of overreach constructions. As a consequence of this lack of regulation, it has had to be the doctrine and –particularly– the jurisprudence that have had to address the assumption of fact trying to offer a solution to the matter. The theory of inverted accession is precisely the almost unanimous solution accepted by the jurisprudence and by most of the authors who try to integrate the existing legal gap in the matter. The development, the systematic analysis of the postulates of this theory and the legal consequences of its application constitute the principal of the present exhibition. Together with this theory, the doctrine of horizontal accession is proposed as an alternative, which will be studied in its most essential aspects.
