This article aims to analyze the position of the Minas Gerais judiciary regarding the alteration of the civil registry of transsexuals. It was necessary to map the judicial decisions published in the TJMG between the years 2010 to 2017 that deal with the theme, using the predominant descriptor “change of name and gender of transsexuals”. As a way of obtaining better results, the research has as its main orientation the theory of body domination taught by Michel Foucault and on gender issues was guided, mainly, by Judith Butler. The role of law as an institution that has control over bodies is evidenced, especially over the subject's self-determination and freedom, with the trans individual always at the mercy of third parties' understandings to express theirgender identity. The deductive method and methodological procedures of bibliographic reviews were used, together with the documentary research of judicial decisions of the TJMG on rectification of the civil registry of transsexuals

O presente artigo visa analisar o posicionamento do judiciário de Minas Gerais sobre à alteração de registro civil de transexuais. Foi necessário realizar mapeamento das decisões judiciais publicadas no TJMG entre os anos de 2010 a 2017 que tratam sobre o tema, utilizando-se descritor predominante “alteração de nome e gênero de transexuais”. Como forma de obter melhores resultados, a pesquisa possui como orientação principal a teoria de dominação dos corpos ensinadas por Michel Foucault e sobre as questões de gênero orientou-se, principalmente, por Judith Butler. Evidencia-se o papel do direito como instituição que possui controle sobre os corpos, principalmente sobre à autodeterminação e liberdade do sujeito, ficando o indivíduo transsempre à mercê de entendimentos de terceiros para expressar sua identidade de gênero. Utilizou-se o método dedutivo e os procedimentos metodológicos de revisões bibliográficas, congregadas à pesquisa documental de decisões judiciais do TJMG sobre retificação do registro civil de transexuais.
