    The aim is to demonstrate that the feeling of risk ends up shaping a new criminal repression system based on new trends and guided by the creation of criminal types that seek to repress the new threats that plague the modern world. Therefore, through the inductive method, it will be demonstrated initially the problems faced by criminal science in protecting the demands originated in the risk society. Afterwards, we will discuss the media discourse that ends up unrestrictedly disseminating fear and legal uncertainty, generating the criminalization of these new risks, as well as their implications for Criminal Law. Finally, will seek establish if a penal system, in a democratic state of law, can receive other characteristics due to the new risks created. It is concluded, at the end of the work, by the possibility of criminal intervention in the protection of risks and social security, provided that respecting the limiting principles of the State's punitive power and the guarantees of the Democratic Rule of Law.

    Objetiva-se demonstrar que o sentimento de risco acaba por moldar um novo sistema de repressão criminal baseado em novas tendências e pautado pela criação de tipos penais que buscam reprimir as novas ameaças que assolam o mundo moderno. Para tanto, através do método indutivo, se demonstrará inicialmente os problemas enfrentadas pela ciência criminal na proteção das demandas originadas na sociedade de risco. Após, se discorrerá sobre o discurso midiático que acaba disseminando irrestritamente o medo e a insegurança jurídica gerando a criminalização desses novos riscos, bem como suas implicações no Direito Penal. Por fim, se buscará estabelecer se um sistema penal, em um estado democrático de direito, pode receber outras características em virtude dos novos riscos criados. Conclui-se, ao final do trabalho, pela possibilidade da intervenção penal na proteção dos riscos e segurança social, desde que respeitados os princípios limitadores do poder punitivo estatal e as garantias do Estado Democrático de Direito.
