El Derecho de la Unión Europea otorga un tratamiento especial a los servicios que se prestan a las personas. La doctrina del Tribunal de Justicia de la Unión Europea (TJUE) ha tenido oportunidad de abordar en varios pronunciamientos los aspectos nucleares de este tratamiento: por un lado, el de las fórmulas de gestión (indirectas) contractuales y no contractuales y sus requisitos de procedencia. Y, por otro, el de las reglas particulares aplicables a la participación de las entidades sin ánimo de lucro en su prestación. Este trabajo revisa la citada doctrina jurisprudencial, prestando especial atención al reciente pronunciamiento del TJUE de 14 de julio 2022 asunto C-436/20 caso ASADE, cuya importancia radica en consolidar algunas líneas interpretativas previas del TJUE y avanzar en la clarificación del tratamiento a estos servicios.
European Union law gives special treatment to services provided to persons. The Court of Justice of the European Union (CJEU) has had the opportunity to address the core aspects of this treatment in several rulings: on the one hand, that of contractual and non-contractual (indirect) management formulas and the conditions for their applicability. And, on the other hand, the particular rules applicable to the participation of non-profit entities in their provision. This paper reviews the aforementioned doctrine, paying special attention to the recent ruling of the CJEU of 14 July 2022 C-436/20 ASADE case, the importance of which lies in consolidating some previous interpretative lines of the CJEU and making progress in clarifying the treatment of these services.
