Vulneración al principio de favorabilidad en la disposición transitoria tercera del Código Orgánico Integral Penal en la aplicación de los beneficios penitenciarios del derogado Código de Ejecución de Penas

    El presente trabajo de investigación científica tuvo como objetivo analizar jurídicamente sobre la vulneración al Principio de Favorabilidad que se está presentando en la aplicación de la Disposición Transitoria Tercera del COIP con respecto a la resolución de los Beneficios Penitenciarios existentes en el anterior Código de Ejecución de Penas, esto debido que de conformidad a la Disposición en mención y según el análisis de algunos Jueces, se interpreta, que sin importar que un reo haya sido sentenciado con el derogado Código Penal, se deberá otorgar los beneficios existentes en el COIP y no aquellos que por principio de Favorabilidad de las normas Ejecutivas correspondería acogerse.

    Este proyecto está desarrollado con un enfoque cualitativo en el cual se utilizó técnicas de recolección de datos como lo es la entrevista directa a los diferentes profesionales del derecho y como instrumento cuantitativo la encuesta a la muestra de la población de abogados en general.

    Con respecto a las entrevistas y encuestas realizadas a los diferentes profesionales del derecho, se hizo el análisis de estos hallazgos para lo cual también se consideró las cifras estadísticas obtenidas, teniendo como resultado la existencia de la vulneración del Principio de Favorabilidad en la aplicación de la Disposición Transitoria Tercera del COIP al momento de resolver las peticiones de Beneficios Penitenciarios del anterior Código de Ejecución de penas.

    En los resultados obtenidos, muchos de los informantes determinan la existencia de Inconstitucionalidad en la Disposición en mención, mientras que otros alegan una errónea interpretación, pero a final de cuentas declaran la existencia de una gran problemática que no solo vulnera el Principio de Favorabilidad, sino que también se estaría vulnerando el Derecho a la Seguridad Jurídica, Tutela Judicial Efectiva, y Principios tales como el de legalidad, retroactividad, irretroactividad y ultra actividad.

    The objective of this scientific research work was to analyze legally the violation of the Favorability Principle that is being presented in the application of the Third Transitory Provision of the COIP with regard to the resolution of the Penitentiary Benefits existing in the previous Code of Execution of Penalties , this because in accordance with the aforementioned provision and according to the analysis of some judges, it is interpreted that regardless of whether an inmate has been sentenced with the repealed Penal Code, the existing benefits in the COIP must be granted and not those that for Principle of Favorability of the Executive rules would correspond to be accepted.

    This project is developed with a qualitative approach in which data collection techniques were used, such as the direct interview with the different legal professionals and as a quantitative instrument the sample survey of the legal population in general. Regarding the interviews and surveys carried out with the different legal professionals, the analysis of these findings was made, for which the statistical figures obtained were also considered, resulting in the existence of the violation of the Favorability Principle in the application of the Third Transitory Provision of the COIP at the moment of resolving the requests of Penitentiary Benefits of the previous Code of Execution of penalties.

    In the results obtained, many of the informants determine the existence of unconstitutionality in the provision in question, while others claim an erroneous interpretation, but in the end they declare the existence of a great problem that not only violates the Principle of Favorability, but also that the Right to Legal Security, Effective Judicial Protection, and Principles such as legality, retroactivity, non-retroactivity and ultra-activity are also being violated.
