Cortes e transformações sociais: o uso dos tribunais para fazer avançar reformas sociais significativas

    O uso de litígios como estratégia para fazer avançar mudanças sociais ensejou produção acadêmica sob diversos sentidos ao longo das últimas décadas. O debate sobre o que se convencionou chamar “cortes e transformações sociais” envolve uma vasta gama de questões que vão desde a separação de poderes e ativismo judicial até análises sobre os efeitos dos litígios e diagnósticos sobre quais condições favorecem ou mitigam a implementação de sentenças. O presente artigo retoma as principais reflexões sobre o papel dos tribunais na produção de mudanças sociais, buscando reconstruir o avanço do debate e apresentar sua configuração atual. Para tanto, são abordados os motivos que levaram a busca pela mudança aos tribunais, as questões democráticas relacionadas e duas abordagens diversas para o estudo sobre estes tipos de litígios. Por fim, apresentam-se os termos atuais do debate. A conclusão do artigo argumenta pela importância do estudo sobre cortes e transformações sociais considerando não apenas a permanência da temática na produção acadêmica, mas sobretudo a continuidade da litigância nesse sentido ao redor do mundo.

    The use of litigation as a strategy to advance social change has prompted a diverse range of academic production over the past decades. The debate on what is conventionally called “courts and social change” involves a wide range of issues from the separation of powers and judicial activism to the analysis of the effects of litigation and the diagnosis of which conditions favour or mitigate the implementation of sentences. This article reviews the main reflections on the role of the courts in the production of social change, seeking to reconstruct the progress of the debate and present its current configuration. To this end, it addresses the reasons that led the search for change to the courts, the related democratic issues and two different approaches to the study of these types of litigation. Finally, the current terms of the debate are presented. The conclusion of the article argues for the importance of the study on courts and social transformations considering not only the permanence of the theme in academic production, but especially the continuity of litigation in this sense around the world.
