    By virtue of the principle of legal reserve, it is up to the Legislative Power of the Union to define crimes. However, in the case of blank criminal laws of heterogeneous complementation, part of the criminal rule is constituted by a complement from a source other than the ordinary law, which is hierarchically inferior. It is discussed, then, if blank criminal laws defy the constitutional principle of legal reserve or if, observing certain limits, the constitutional filtering of the incriminating rule is positive. Special emphasis is given to the solution given by the Federal Supreme Court to the matter, starting from Theme 1.246.

    Por força do princípio da reserva legal, compete ao Poder Legislativo da União definir crimes. Porém, no caso de leis penais em branco de complementação heterogênea, parte da regra penal é constituída por complemento proveniente de fonte diversa da lei ordinária, hierarquicamente inferior. Discute-se, então, se leis penais em branco afrontam o princípio constitucional da reserva legal ou se, observados determinados limites, a filtragem constitucional da regra incriminadora é positiva. Dá-se especial ênfase à solução dada pelo C. Supremo Tribunal Federal ao assunto, a partir do Tema 1.246.
