O direito educacional sob o viés da judicialização no contexto do ensino na educação básica

    Neste artigo enfatiza-se que a educação precisa estar associada ao direito para que os educadores tenham subsídios suficientes e saibam a quem recorrer nos momentos em que a escola, por si só, não consiga sanar dúvidas e problemas, como indisciplina e atos infracionais ou a negação do direito das crianças e adolescentes. Procura-se, também, mostrar uma panorâmica sobre a Educação Básica e as garantias dos direitos sociais, chancelados pela LDB (Lei das Diretrizes e Bases da Educação), Estatuto da Criança e do Adolescente e da Constituição Federal do Brasil. O objetivo do presente trabalho é mostrar os avanços legais que amparam a Educação Básica. Foi desenvolvida um estudo baseado em autores que se empenham em esclarecer as vertentes e origens do Direito Educacional, tendo como pano de fundo a judicialização da educação, seu embasamento legal e os órgãos responsáveis em amparar os gestores educacionais, a exemplo, Conselho Tutelar, Ministério Público, Polícia Civil e o Judiciário.

    In this article, it is emphasized that education must be associated with the right for educators to have sufficient subsidies and know who to turn to at times when the school, by itself, can not solve doubts and problems, such as indiscipline and infractions or Denying the rights of children and adolescents. It also seeks to show an overview of Basic Education and the guarantees of social rights, approved by the LDB (Law of the Guidelines and Bases of Education), Statute of the Child and Adolescent and the Federal Constitution of Brazil. The objective of the present work is to show the legal advances that support the Basic Education. A study was developed based on authors who strive to clarify the strands and origins of Educational Law, having as background the judicialization of education, its legal basis and the bodies responsible for supporting educational managers, for example, Tutelary Council, Ministry Public, Civil Police and Judiciary.
