A metáfora contra a metáfora: Materialidades da Comemoração de Direitos

    In this text, I undertake a gesture of analysis in the space of the commemoration of rights in our present. I intend, from the theoretical device of Materialist Discourse Analysis, to read, in their mutual and irreducible heterogeneity, the materialities that overdetermine this discursive practice of commemoration, in the contemporary and everyday bond they establish with the wooden language of the legal. The description/interpretation beat allows to advance theoretically in an understanding of the functioning of the juridical in our time, which, in my opinion, summons us to a balance of concepts, distinctions, descriptive and explanatory moments. I will try to give a consequence to this, outlining a resumption (with difference) of Althusserian formulations – especially those that can be found in chapters V and XI of On reproduction – about Law and the functioning of legal ideology. This resumption aims to reassemble them from Edelman (The right captured by photography) to Pêcheux (There is only cause of what fails and Delimitations, inversions, displacements). The proposed beat provides elements to reposition scaffolding: a) to re-semanticize the concept of legalism from the concept of resistance; b) make the concept of hermeticism historically pronounced – in a practical state in Milner’s Love of Language.

    Neste texto, empreendo um gesto de análise no espaço da comemoração de direitos no nosso presente. Objetivo, a partir do dispositivo teórico da Análise de Discurso Materialista, ler, em sua mútua e irredutível heterogeneidade, as materialidades que sobredeterminam tal prática discursiva de comemoração, no laço contemporâneo e cotidiano que estabelecem com a língua-de-madeira do jurídico. O batimento descrição/interpretação permite avançar teoricamente numa compreensão do funcionamento do jurídico em nosso tempo, a qual, segundo penso, convoca-nos a um balanço de conceitos, distinções, momentos descritivos e explicativos. Tratarei de dar consequência a isso, esboçando uma retomada (com diferença) das formulações althusserianas – especialmente, as que se pode encontrar nos capítulos V e XI de Sobre a reprodução – acerca do Direito e do funcionamento da ideologia jurídica. Retomada essa que visa a remontá-las de Edelman (O direito captado pela fotografia) a Pêcheux (Só há causa daquilo que falha e Delimitações, inversões, deslocamentos). O batimento ora proposto fornece elementos para reposicionar andaimes: a) ressemantizar o conceito de juridismo desde o conceito de resistência; b) tornar historicamente pronunciado o conceito de hermetismo – em estado prático em O amor da língua, de Milner.
