  Hoy en día, es una realidad ineludible que los avances en neurotecnología han experimentado un avance significativo, poniendo sobre la palestra, la incertidumbre en torno a la posibilidad de escrutar e incluso llegar a controlar el cerebro humano, y junto con ello nuestras emociones o pensamiento. Dicha realidad ha dado lugar a corrientes dentro del Derecho, que abogan por la sistematización y regulación de un conjunto de derechos asociados a la protección y defensa de una suerte de indemnidad o inviolabilidad de “lo mental”. Otorgando incluso la categoría de derecho humano fundamental a esta serie de llamados neuroderechos. El ensayo que sigue, pretende responder al cuestionamiento en torno a qué compromiso filosófico existe detrás de una propuesta de legislación de neuroderechos A fin de dilucidar cuestiones tan esenciales como la posibilidad de certeza en torno a la existencia de otras mentes, como presupuesto básico para formular cualquier tipo de regulación.
