    Este artigo movimenta algumas questões referentes à participação política indígena de acordo com as bases teóricas do “constitucionalismo democrático latino americano”. O objetivo central consiste em compreender parcela dos desafios da experiência constitucional brasileira tendo em vista as disputas pelo território da aldeia indígena Maracanã localizada na cidade do Rio de Janeiro/RJ. Busca-se identificar como essas tensões sociais e jurídicas se materializam e as dificuldades impostas pelas utilizações autoritárias dos elementos de origem popular. Para tanto, utiliza-se a revisão de literatura e a análise documental para identificar as respostas que o marco teórico e as práticas institucional e social brasileiras oferecem. Chega-se à conclusão de que as práticas analisadas dificultam a compreensão e o tratamento adequado da questão territorial indígena.

    This article moves some issues concerning indigenous political participation according to the theoretical foundations of “Latin American democratic constitutionalism”. The central objective is to understand part of the challenges of the Brazilian constitutional experience in view of the disputes over the territory of the indigenous village Maracanã located in the city of Rio de Janeiro/RJ. It seeks to identify how these social and legal tensions materialize and the difficulties imposed by the authoritarian uses of the elements of popular origin. To this end, the literature review and the document analysis uses to identify the answers that the theoretical framework and Brazilian institutional and social practices offer. The conclusion is that the practices analyzed make it difficult to understand and deal adequately with the indigenous territorial issue.
