The ideal is that the proportions of the interested parties are constituted by assets belonging to the heritage to be shared, whether it be an inheritance or a conjugal heritage. However, in practice, there are, due to several factors, serious difficulties in carrying out the sharing without being awarded to one or more interested parties whose value, taken as a whole, exceeds the value of the respective share.
Generally, in shares carried out through inventory, this excess results from bidding and constitutes a source of the obligation to pay to pecuniary compensation.
Considering the recent reform of the inventory process, operated by Lei n.º 117/2019, de 13/09, and the practical interest in matters of excessive bidding and payment of pecuniary compensation, this text aims to identify the innovations brought by the new inventory regime regarding these matters. It also seeks to analyze the reflexes of such innovations for the desired improvement of the inventory process regime.
Idealmente, os quinhões dos interessados devem ser formados com bens pertencentes ao património a partilhar, seja este uma herança ou um património conjugal. Contudo, na prática, surgem, por diversos fatores, sérias dificuldades em se realizar a partilha sem que a um ou mais interessados sejam adjudicados bens cujo valor, no seu conjunto, exceda o valor do respetivo quinhão. Geralmente, nas partilhas realizadas por meio de inventário, esse excesso resulta de licitação e constitui fonte da obrigação do pagamento de tornas.
Considerando a recente reforma do processo de inventário, operada pela Lei n.º 117/2019, de 13/09, e o interesse prático das matérias do excesso de licitação e pagamento de tornas, o presente texto visa identificar as inovações trazidas pelo novo regime a respeito dessas matérias. Procura-se também analisar os reflexos de tais inovações para o almejado aprimoramento do regime do processo de inventário.
