Resumen de La intertextualidad en el lenguaje jurídico. Reflexión y aplicación en una ley medioambiental italiana

La intertextualidad se postula como uno de los elementos sustanciales para el análisis y comprensión de los textos, pues es el elemento esencial que dota de sentido a la macroestructura y se encuentra tanto implícita como explícitamente, del mismo modo que exige en el lector un conocimiento previo. Este deberá interpretar la función de descodificador de la información a través de las diferentes redes de transtextualidad creadas con otros textos, máxime cuando se corresponda con la figura de un traductor. En el presente artículo, introducimos el concepto de intertextualidad en lingüística y reflexionaremos sobre los contextos más recurrentes en donde tienen lugar estas relaciones textuales. Posteriormente, detallamos la importancia que posee en el lenguaje jurídico al ser un lenguaje de especialidad que recoge con exhaustividad todas las casuísticas posibles en su cometido de ser lo más preciso posible. A tal respecto y, por último, detallamos los casos prácticos de intertextualidad detectados en la Ley italiana sobre medioambiente 68/2015, de 22 de mayo, con el fin de alertar al traductor de textos jurídicos de la importancia de saber tejer redes intertextuales en tal lenguaje para su correcta traducción.

Intertextuality is postulated as one of the substantial elements for the analysis and understanding of texts, since it is the essential element that gives meaning to the macro-structure and is found both implicitly and explicitly, in the same way that it requires the reader to have previous knowledge. He or she must interpret the function of decoding information through the different networks of transtextualitycreated with other texts, especially when this corresponds to the figure of a linguistic mediator. In this article, we introduce the concept of intertextuality in linguistics and reflect on the most recurrent contexts where these textual relationships take place. Subsequently, we detail the importance that it has in legal language as it is a language of specialisation that exhaustively covers all the possible casuistry in its task of being as precise as possible. In this respect, and finally, we propose to detail the practical cases of intertextuality detected in Italian Law 68/2015 of 22 May on the environment, with the aim of alerting the translator of legal texts to the importance of knowing how to weave intertextual networks in such language for their correct translation.
