En los préstamos hipotecarios con consumidores, las condiciones generales que versan sobre el objeto principal del contrato deben superar, para que pueda enjuiciarse su carácter abusivo, un doble control previsto tanto en la LCGC como en el TRLGDCU. En primer lugar, el llamado control de incorporación, destinado a verificar que el consumidor (prestatario) tuvo la posibilidad de acceder al contenido contractual predispuesto por el profesional (condicionado general del contrato o cláusulas no negociadas) y que tales cláusulas estaban redactadas de una forma clara y comprensible. En segundo lugar, el control de transparencia, que tiene como objetivo determinar si el consumidor llegó a comprender realmente la carga económica y jurídica que estaba asumiendo en el contrato de préstamo.
