    This article proposes a re-reading about the relationship established between patients and health care professionals from the perspective of human rights. Currently, in the Brazilian Civil Law, this relationship is understood as a consumer relationship maintained according to the Objective Good Faith Principle. It is concluded that this legal framework insufficient to protect the patient. It is a theoretical research based on human rights standards and their application in health care which includes both the rights of patients and the rights of health professionals, both composing the Human Rights of Patients. The topic is rarely addressed in Brazil and there is no specific legislation on the rights of patients in the country.

    O artigo propõe uma releitura da relação estabelecida entre o profissional de saúde e o paciente a partir da ótica dos direitos humanos. Atualmente, essa relação é entendida pelo Direito Civil brasileiro como uma relação jurídica obrigacional, mais especificamente, como uma relação de consumo que sofre os influxos do Princípio da Boa-fé Objetiva. Sustenta-se que tal enquadramento jurídico é insuficiente para proteger o indivíduo acometido por uma enfermidade. O trabalho tem caráter teórico-normativo e fundamenta-se nas normativas de direitos humanos aplicadas aos cuidados em saúde o que inclui tanto os direitos dos pacientes quanto os direitos dos profissionais de saúde, ambos compondo o referencial internacional dos Direitos Humanos dos Pacientes. Trata-se de tema pouco abordado no Brasil, inexistindo legislação específica sobre os direitos dos pacientes no país.
