    No presente artigo se analisa a Constituição de 1891 e sua inefetividade constitucional, suas promessas não realizadas de refundação do país, dando ênfase aos aspectos jurídicos, políticos e ideológicos que envolveram o drama da inefetividade da Constituição de 1891. A abordagem proposta está centrada na disputa política e ideológica dos liberais e conservadores em torno da interpretação da Constituição, com a verificação que a interpretação conservadora da Constituição prevaleceria por toda a Primeira República, justificada a partir de uma ideologia aristocrática, ultra-presidencialista, ultra-federalista, situacionista, reacionária contra qualquer reforma, obcecada pela defesa da hierarquia social.

    The present article analyzes the 1891 Constitution and its constitutional ineffectiveness, their unrealized promises of rebuilding the country, emphasizing the legal, political and ideological aspects of the drama surrounding the ineffectiveness of the 1891 Constitution.

    The proposed approach focuses on the political and ideological struggle of the liberals and conservatives around the interpretation of the Constitution, with verification that the conservative interpretation of the Constitution would prevail throughout the First Republic, justified from an aristocratic ideology, ultra-presidential, ultra-federalist, situationist, reactionary against any reform, obsessed with defense of social hierarchy.
