El derecho a la integridad de la obra artística: el mural del Centro Comercial San Diego como estudio de caso

    El artículo describe el derecho a la integridad de la obra a partir del conjunto de postulados doctrinales, jurisprudenciales y de la normatividad vigente en Colombia. Adicionalmente se lleva a cabo un estudio de caso a partir de la primera sentencia de la Dirección Nacional de Derecho de Autor, en funciones jurisdiccionales; caso que plantea una tensión entre la integridad como derecho moral de autor sobre una obra artística versus su temporalidad y limitaciones, y en relación al soporte donde se encuentra plasmada. La metodología empleada conllevó el análisis de las fuentes y el estudio descriptivo del caso. Como resultados, se presentan algunas reflexiones del alcance de este derecho, así como una serie de reflexiones críticas sobre el fallo de segunda instancia que está actualmente en firme.

    This paper describes the right to the integrity of the work in the field of copyright, through normative, theoretical and jurisprudential sources in Colombian law. The authors also propose a case study of the first sentence of the Colombian Copyright Office. A case that demonstrates the existence of the tension between the integrity and perpetuity of a mural as a artistic work versus its temporality and the limitations of moral author rights. The methodology used involved the analysis of the sources cited, and the descriptive study of the case. As results, the authors present some reflections on the right to the integrity of the work, as well as a criticism of the second instance sentence that is currently in force.
