    The article aims to analyze the relationship between philosophy and justice in the historical course of humanity. In this intertwining philosophy and justice will be to detect the influences on the right in the path of humanity, seeking to understand the basis of the right in the course of history, in order to explain what were the precípuas jusfilosóficas slopes over time, draining the post modernity and model adiáforo law justified at present, more steeped in technique and efficiency, less committed to the integument and legal ontology. Will exhibit significant currents of philosophical thought and its connection with the fair in the legal field. Address will be the theme dialectically with procedures and comparative historical events glimpsed in sequence, for in the end, provide a constructivist concept of justice that foundation and give validity to right this instant coeval.

    O artigo se propõe a analise da relação entre a filosofia e a justiça no percurso histórico da humanidade. Nesse entrelaçamento entre filosofia e justiça haverá de se detectar as influências sobre o direito na trajetória da humanidade, buscando a compreensão do fundamento do direito no curso da história, a fim de explicar quais foram as precípuas inclinações jusfilosóficas ao longo do tempo, desaguando na pós-modernidade e no modelo adiáforo de direito justificado presentemente, mais impregnado de técnica e eficiência, menos comprometido com o tegumento e a ontologia jurídicas. Serão expostas as correntes expressivas do pensamento filosófico e sua conexão com o justo no campo jurídico. Abordar-se-á o tema dialeticamente, com procedimentos históricos e comparativos entre os acontecimentos vislumbrados em sequencia, para, ao final, fornecer-se um conceito construtivista de justiça que dê fundamento e validade ao direito neste instante coevo.
