    O objetivo do presente artigo é lançar luz sobre o processo de constituição da experiência jurídica no Brasil a partir do século XVI. Para tanto, procurou-se analisar brevemente a legislação aplicável e a concepção de Direito então vigentes para destacar o papel central da justiça no contexto do Antigo Regime português e seu modelo de sociedade corporativa. Pretende-se, em um segundo momento, destacar o momento inaugural da extensão da ordem jurídica portuguesa para as terras do Brasil e, por fim, as linhas gerais da organização da justiça na experiência colonial. Para realização do estudo, lançou-se mão de pesquisa bibliográfica que já se debruçou sobre o tema, numa espécie de síntese dos principais autores, mas abordando-os à luz dos novos esforços da historiografia por compreender a experiência colonial com base no conceito de monarquia pluricontinental. Os resultados obtidos revelam que os momentos iniciais do Direito no Brasil se apresentam não sob o signo da legislação, como se suporia anacronicamente, mas sobretudo pela via da jurisdição.

    The purpose of this article is to shed light on the process of constituting juridical experience in Brazil from the 16th century onwards. To this end, we sought to briefly analyze the applicable legislation and the conception of Law then in force to highlight the central role of justice in the context of the Old Portuguese Regime and its model of corporate society. It is intended, in a second moment, to highlight the inaugural moment of the extension of the Portuguese juridical order to the lands of Brazil and, finally, the general lines of the organization of justice in the colonial experience. To carry out the study, bibliographic research was used, which has already focused on the theme, in a kind of synthesis of the main authors, but approaching them in the light of the new efforts of historiography for understanding the colonial experience based on the concept of pluricontinental monarchy. The results obtained revea that the initial moments of Law in Brazil are presented not under the sign of legislation, as would be assumed anachronistically, but above all through the jurisdiction.
