    Se analizan los requisitos establecidos en el artículo 89 de la LJCA para tener por preparado un recurso de casación. El Auto, de 14 de febrero de 2020, de la Sección Primera de la Sala de lo Contencioso-Administrativo del Tribunal Supremo establece que, a la Sala o Juzgado de instancia, sólo le corresponde verificar el cumplimiento de los requisitos procesales del escrito de preparación del recurso, no los sustantivos, cuyo análisis compete, en exclusiva, al Tribunal Supremo.

    This commentary analyzes the requirements established in article 89 of Law 29/1998 concerning the preparation of the contentious-administrative appeal before the Supreme Court. The Supreme Court has confirmed in the resolution of February 14, 2020, that the court of instance only has the legal authority to verify that the appellant fulfils the procedural requirements -not substantive- in the appeal before the Supreme Court. The legal authority to verify the fulfilment of substantive requirements corresponds to the Supreme Court.
