La reconciliación en la corte penal internacional: ¿realidad o utopía?

    El presente estudio tiene como objeto de análisis la perspectiva la reconciliación en la Corte Penal Internacional a través de su función restaurativa. Esta función permite a la Corte configurar un nuevo modelo de justicia internacional penal que se centra en la víctima, no solamente en el delincuente. De este modo, la CPI pone de relieve que debe ir más allá de los tribunales internacionales de carácter penal predecesores, y se demostrará en la operatividad y eficacia de la función antedicha y en el logro de la reconciliación. Así, la CPI será un tribunal que imparta una justicia más adecuada para las víctimas.

    The aim this work is the analysis on the legal perspective of reconciliation of the International Criminal Court through his restorative role. This role allows the Court to configure new model of international criminal justice that focuses on the victims, not just the criminal. Thus, the ICC must go beyond previous international criminal courts, and this will be demonstrated efficacy of the above restorative role and in the achievement of the reconciliation, towards a solution which is more inclusive. Thus, the ICC will not only be a Court that will provide more appropriate justice for victims before the ICC.
