Resumen de Direito penal e imigração: aspectos de legitimação e política criminal

  This article deals with the problems that the social phenomenon of immigration, accentuated by the growing flow of people in the world, brings to criminal law and its foundations. It focuses on the democratic legitimacy of criminalization, a theory of interpretation and application of criminal law based on the systematization of constitutional guarantees, the structure of criminal imputation and the need to refer to social norms for the solution of imputation problems. The article proposes and justifies a democratic theory of criminalization that also includes people without formal political participation, based on the capacity of generalization of interests and on the principle of discourse inspired by Habermas’ philosophy. For the solution of problems linked to the ignorance of the criminal law, it suggests a model that includes the capacity of the author to participate in the debate about his accountability as a basis for assessing his possibility to avoid that ignorance of law. Finally, the relationship between immigration and populist criminal policy is analyzed, emphasizing the identification of the immigrant with the figure of an enemy and insisting on the need to rationalize criminal discourse based on standards of justice and human rights protection.

  O presente artigo trata dos problemas que o fenômeno social da imigração, acentuado pelo crescente fluxo de pessoas no mundo, traz ao direito penal e suas bases de fundamentação. Enfoca-se a legitimidade da incriminação de condutas, a partir de uma teoria democrática do bem jurídico, uma teoria da interpretação e da aplicação do direito penal baseada na sistematização das garantias constitucionais, a estrutura da imputação penal e a necessidade de recorrer a normas sociais para a solução de problemas dogmáticos. O artigo propõe e justifica uma teoria democrática do bem jurídico que inclua também pessoas sem participação política formal, baseada na capacidade de generalização de interesses e no princípio do discurso de inspiração na filosofia de Habermas. Para a solução de problemas vinculados ao erro de proibição, sugere um modelo que inclua a capacidade do autor de participar no debate acerca da sua responsabilização como fundamento para avaliar a evitabilidade do erro. Por fim, analisa-se a relação entre imigração e política criminal populista, salientando a identificação do imigrante com a figura do inimigo e insistindo na necessidade de racionalização do discurso penal a partir de standards de justiça e proteção da pessoa humana.
