    This article aims to analyze the serious structural omissions related to the fundamental right to health. Based on the premise that the right to health derives directly from the right to life and dignity of the human person, it aims to analyze a possible basis for the intervention of the Judiciary in public policies. The paper will use the concept of '' State of Things Unconstitutional '' created by the Colombian court and applied by the Federal Supreme Court as an attempt to analyze the injuries to the fundamental right to health, seeking the reasons that support the existence of an unconstitutional reality. This situation mainly affects a large part of the country's most deprived population, which does not have the resources to afford a private health plan, and has to rely on the Unified Health System. The concept of Unconstitutional Things State suffers severe criticism from traditional doctrine , mainly regarding the separation of powers. In view of the above, would judicial intervention through the State of Unconstitutional Stuff solve the serious unconstitutional omission that comes from day to day injuring the fundamental right to health without hurting the postulate of the separation of powers? The purpose of this article is to analyze the unconstitutional reality that damages the fundamental right to health from the theory of the State of Things Unconstitutional, analyzing its assumptions, its legitimacy and its effects. Therefore, the importance of research will be given in the implementation of the institute in the Brazilian legal system. Finally, the article will use the qualitative method, starting with doctrinal studies, articles, books and judicial decisions

    O presente artigo visa analisar as graves omissões estruturais relacionadas ao direito fundamental à saúde. Partindo da premissa que o direito à saúde deriva diretamente do direito à vida e da dignidade da pessoa humana, objetiva-se analisar uma possível fundamentação para a intervenção do Poder Judiciário nas políticas públicas. O trabalho utilizará o conceito de ‘’Estado de Coisas Inconstitucional’’ criado pela corte colombiana e aplicado pelo Supremo Tribunal Federal como uma tentativa de analisar as lesões ao direito fundamental à saúde, buscando os motivos que sustentam a existência de uma realidade inconstitucional. Esta situação afeta, principalmente, boa parte da população mais carente do país, que não possui recursos para arcar com um plano de saúde privado, restando contar com o Sistema Único de Saúde. O conceito de Estado de Coisas Inconstitucional sofre severas críticas da doutrina tradicional, principalmente quanto à separação dos poderes. Diante do exposto acima, a intervenção judicial através de Estado de Coisas Inconstitucional resolveria o problema da grave omissão inconstitucional que vem dia a dia lesionando o direito fundamental à saúde sem ferir o postulado da separação dos poderes? O objetivo desse artigo é analisar a realidade inconstitucional que lesiona o direito fundamental à saúde a partir da teoria do Estado de Coisas Inconstitucional, analisando seus os pressupostos, sua legitimidade e seus efeitos. Logo, a importância da pesquisa se dará na implementação do instituto no ordenamento jurídico brasileiro. Por fim, o artigo usará o método qualitativo, partindo de estudos doutrinários, artigos, livros e decisões judiciais
