    Once the globalization phenomenon is established, the acquisition of facilitating means of integration and interaction between the countries of the regions becomes essential, given that, mainly, essential and common patterns invade the world-wide - requiring, in terms of Marcelo Neves , the methodology of transconstitutionalism and the path of reciprocal learning paths. In Latin America, especially, the process of association is engendered by historical perspectives of submission and domination to countries of imperialist culture. Thus, this article, through a bibliographical and jurisprudential study, seeks to analyze the legal conditions of entry and residence of the migrant worker in the member states of Mercosur (Argentina, Brazil, Paraguay and Uruguay), in the light of regional exchange, human rights and the context of the Democratic State of Law.

    Vez que o fenômeno globalizatório estabelece-se, a aquisição de meios facilitadores de integração e interação entre os países das regiões torna-se imprescindível, haja vista que, principalmente, pautas essenciais e comuns invadem o âmbito mundial – exigindo, em termos de Marcelo Neves, a metodologia do transconstitucionalismo e o trilho de caminhos de aprendizado recíproco. Na América Latina, especialmente, o processo de associação é engendrado por perspectivas históricas de submissão e dominação aos países de cultura imperialista. Assim, o presente artigo, por meio de estudo bibliográfico e jurisprudencial, busca analisar as condições jurídicas de ingresso e permanência do trabalhador migrante nos estados membros do Mercosul (Argentina, Brasil, Paraguai e Uruguai), sob à luz do intercâmbio regional, dos direitos humanos e do contexto do Estado Democrático de Direito
