Con la presente investigación se pretende demostrar que el balancing test de Ronald Dworkin y la ponderación de Robert Alexy son completamente diferentes tanto a nivel teórico como en sus consecuencias prácticas, razón por la cual es importante diferenciarlos a pesar de que, en Colombia, tanto la doctrina como la jurisprudencia constitucional los ha asimilado equivocadamente.

With the present investigation it is tried to demonstrate that the Balancing Test by Ronald Dworkin and the Weighing Procedure by Robert Alexy are completely different at both theoretical and at its practical consequences, this is why it is important to differenciate them even though, in Colombia, both doctrine and case law have mistakenly assimilated them.
