    En este trabajo, el autor aborda la polémica cuestión de la definición jurídica de la obra de arte como una mera excusa para acotar su proteica virtualidad en la sociedad. Partiendo de conceptos tan evanescentes como «bagatela» o «buen gusto», se intenta perfilar una doble naturaleza teleológica, y a la vez jurídica, en las obras de arte. Por un lado, se analiza el arte como manifestación subversiva contra el poder establecido en nuestra historia reciente. Por otro, se estudia la utilización del arte como instrumento transgresivo del orden social y jurídico de valores. En este último sentido, se analizan casos muy polémicos para intentar definir los derechos y límites existentes –o deseables– en torno a la creación artística. En concreto, se perfila el ámbito de la creación artística en torno a los sentimientos y creencias religiosas, la libertad de expresión, la representación del racismo y del genocidio, el debido respeto a las víctimas de los delitos terroristas, la protección de la juventud y la infancia frente a la pornografía, el uso de los espacios públicos y la irresoluta cuestión de la tauromaquia.

    In this work, the author addresses the controversial question of the legal definition of the concept of piece of art as a mere excuse to limit its role and impact in society. On the basis of evanescent concepts such as «trifle» or «elegant taste», the text tries to outline a teleological and legal double nature of a work of art. On the one hand, art is studied as a subversive representation against the vested powers in our recent history. On the other, the text analyses the use of art as a transgressive instrument of fundamental values of social order. In the latter sense, some very controversial cases are discussed in order to shape the existing –or desirable– rights and limits to artistic creation. In particular, the scope of artistic creation is confronted with the protection of religious sentiments and beliefs; freedom of expression; the representation of racism and genocide; the due respect for victims of terrorist crimes; the protection of youth and children from pornography; the use of public spaces and, finally, the unresolved question of bullfighting as an artistic performance.
