O princípio do resgate e a questão do seguro hipotético em dworkin no âmbito do direito à saúde: Possibilidades e limites do livre mercado e a aplicação da justiça

    O propósito fundamental desse artigo consiste em desenvolver uma discussão sobre as relações entre o direito à saúde e a lógica de mercado, tendo por referência teórica o ideal do “seguro hipotético” de Ronald Dworkin. Para tanto, evidencia-se os argumentos fundamentais que identificam as possibilidades do livre mercado na temática do direito à saúde, demarcando a ideia de eficiência a partir da relação entre a produção e o custo. Com base nesse pressuposto, a tarefa substancial será a de desenvolver uma reflexão plausível sobre a relação intrínseca entre as políticas de livre mercado e o direito de acesso à saúde. Trata-se, portanto, de colocar em questão os limites e possibilidades do livre mercado quando aplicado à saúde ao evidenciar o princípio do resgate e a alternativa do seguro hipotético no âmbito do pensamento de Dworkin.

    The essential purpose of this article is to develop a discussion on relations between the right to health and the logic of the market by reference to the theoretical ideal of "safe hypothetical" of Ronald Dworkin. For both, highlights the crucial arguments that identify the possibilities of the free market in the theme of the right to health, demarcating the idea of efficiency from the relationship between production and the cost. Based on this assumption, the substantial task will be to develop a reflection plausible on the intrinsic relationship between free market policies and the right of access to health. This is, therefore, to question the limits and possibilities of the free market when applied to health to emphasize the principle of redemption and the alternative of hypothetical insurance under the thought of Dworkin.
