    O objetivo do presente artigo é, a partir da discussão sobre os julgados acerca da presunção de inocência, refletir sobre os limites do poder de decisão do STF e a tensão existente entre as garantias consagradas historicamente pela dogmática penal e a pretensão de efetividade das decisões em matéria criminal. Defende-se que o Tribunal Constitucional não detém a última palavra no tocante à interpretação da Constituição, principalmente no que diz respeito à restrição das garantias penais-constitucionais. Por fim, o posicionamento aqui esboçado se desenvolve no sentido de sustentar o papel da crítica acadêmica aos julgados como contrapeso por excelência à atividade pretoriana daquele tribunal.

    This article aims to discuss the judgments on the presumption of innocence, to reflect on the limits of the power of the Supreme Court concerning its decision’s making and the measure of the guarantees consecrated historically by criminal dogmatics and pretension of effectiveness. It is argued that the Constitutional Court does not have the final word regarding the interpretation of the Constitution. This is true with regard to the restriction of criminal-constitutional guarantees. Finally, it will be sustained that the role of academic critique to those judged is a counterweight par excellence to the praetorian activity of that court.
