    The surrogacy Act (Law no. 25/2016, of August 22), may open the doors to the establishment of the maternity in Portugal by means of contract, reason why a tight inspection is required. On the other hand, the right of all women to procreate (Law no. 17/2016 of 20 June) overlapped the right of the child to know and maintain a legal and family relationship with both parents, a right that during the last century was advocated by progressive voices. In turn, the subsidiary character of the PMA has also been postponed, since it guarantees the access of any woman, however fertile and heterosexual, to the assisted reproduction techniques. Thus, the right of membership and the system of medically assisted procreation were seriously transformed by legislative changes in 2016

    O regime da “gestação de substituição” implementado em Portugal, pela Lei n.º 25/2016, de 22 de Agosto, pode abrir as portas a uma contratualização do estabelecimento da maternidade, pelo que se impõe uma fiscalização apertada. Por outro lado, o direito de todas as mulheres a procriar (Lei n.º 17/2016, de 20 de Junho) sobrepôs-se ao direito de a criança conhecer e manter uma relação jurídica e familiar com ambos os progenitores, direito esse que ao longo do último século se vinha afirmando pelas correntes mais progressistas. Por seu turno, o caráter subsidiário da PMA foi também postergado, uma vez que se garante o acesso de qualquer mulher, ainda que fértil e heterossexual, às técnicas de PMA. Assim, o direito da filiação e o regime da procriação medicamente assistida foram seriamente transformados pelas alterações legislativas ocorridas em 2016.
