  Dicho estudio aborda el origen, desarrollo y evolución del sistema francés de protección social de las personas dependientes hasta la actualidad, incluyendo las reformas aprobadas por la importante Ley de 2015. Un sistema concebido al margen del sistema de Seguridad Social, e incluido dentro de la asistencia social en Francia. De forma nuclear, se analizan las características que distinguen a la prestación del APA sobre la que gira el sistema por entero, examinándose las condiciones para tener derecho a la prestación, así como las notas principales que distinguen al APA. Finalmente, se desvela el procedimiento para el reconocimiento del derecho a la prestación, que con la última reforma atiende a la persona dependiente y a sus cuidadores más próximos o allegados, prestando especial interés por el Plan Individual de Atención (a domicilio).

  This study addresses the origin, development and evolution of the French system of social protection for dependent el elderly persons until the present. The study includes the reforms approved by the important 2015 Act. The French system was designed outside the Social Security System, and developed in the field of social assistance. In this regard, are analyzed the legal characteristics of the Long Term Care benefit (the APA), with special attention to the conditions for entitlement to the benefit and other main features of the APA. Then, the article analyzes the procedural nature of the right to LTC benefits and describes the processes that lead to the implementation of the Individual Plan of Care (in home). Finally, are examined the challenges and the main issues addressed by the 2015 reform, with special regard to the legal status of caregivers.
