    La concepción y estructura del derecho a la educación como derecho fundamental implica el reconocimiento de posiciones jurídicas exigibles, que se traducen en prestaciones positivas y negativas. En el presente trabajo indagaremos sobre el alcance y vigencia del derecho a la educación en las bases constitucionales y normativas de la Argentina y a través de la reconstrucción de los contenidos presentes en las obligaciones del Estado de respetar, proteger, hacer cumplir y garantizar el derecho.

    The concept and structure of the right to education as a fundamental right implies the recognition of enforceable legal positions, which can be studied as positive and negative rights. In this paper we investigate the scope and enforcement of the right to education contents according to Argentinian constitutions norms and through the reconstruction of the contents of the States obligations to respect, protect, enforce and guarantee the right.
