This article aims to discuss the possibility of reopening criminal procedures against defendants that were once declared innocent. It does so by analyzing cases that illustrate how the development of specific Technologies can produce new evidence of crimes committed by persons previously declared innocent. The article then presents the criminal implications of this scenario according to the norms and jurisprudence in Germany. Given the growing number of such cases there is now a reform project of the German Criminal Procedure Code – which will be discussed extensively – that aims to evise and widen the hypothesis of reopening previously decided criminal procedures. Also taken into account are fundamental questions regarding the trade off between an offense against the res judicata and material justice principles, which are in turn contrasted according to a liberal criminal law perspective.
