Resumen de Teoría de la Justicia, Ciencia Jurídica y crítica del Derecho: contribución preliminar para un programa de crítica radical del Derechoo

  Mi objetivo en este artículo es diferenciar e identificar, con cierta precisión semántica, los varios y confusos modos en que se emplean los términos “ius-naturalismo”, “ius-positivismo” y “crítica”.

  Primero, mostraré la incómoda polisemia de esos términos. Luego, sugeriré un cambio de vocabulario para evitar las cansadoras controversias que esas confusiones terminológicas crean en los ámbitos académicos del derecho.

  Finalmente, y de manera subsidiaria, intento mostrar la compatibilidad y complementariedad entre un programa de Crítica Radical del derecho y la conceptualización kelseniana del derecho y el Estado.

  My goal in this article is to differentiate and to identify, with some semantic precision, the various and confusing ways in which the terms “ius-naturalism”, “ius-positivism” and “critique” are used.

  First, I will show the uncomfortable polysemy of these terms. Then, I will suggest a change of vocabulary to avoid the tiring controversies created by these terminological confusions in the academic areas of law.

  Finally, and in a subsidiary way, I intend to show the compatibility and complementarity between a program of a Radical Critique of Law and the Kelsenian conceptualization of the State and the law.
