    Open Educational Resources (OER) have become an important tool in the teaching and learning process, assisting, including, in scientific research. Despite the advances, open education and open educational resources in Brazil still remain very discrete. This is a trend of the scientific world, focused mainly on higher education, post-graduation and extracurricular courses. The diversity of open channels where we find materials for legal studies is immense. Considering the technological advances and the speed with which scientific productions are arriving in cyberspace, mainly in legal education, where the diversity of jurisprudential and doctrinal understandings can walk in opposite directions, it is necessary to know well the sources and references used to make use of these materials. In this perspective, this study intends to find legal sources in Open Educational Resources, cataloging and identifying the licences used, highlighting the conflicts found between copyright and available resources in order to disseminate this information in the scientific environment.

    Os Recursos Educacionais Abertos (REA) vêm se tornando uma importante ferramenta no processo de ensino e aprendizagem, auxiliando, inclusive, nas pesquisas científicas. Apesar dos avanços, a educação aberta e os recursos educacionais abertos, no Brasil, ainda se mantêm muito discretos. Essa é uma tendência do mundo científico, voltada principalmente ao ensino superior, às pós-graduações e aos cursos extracurriculares. É imensa a diversidade de canais abertos em que se encontram materiais para estudos jurídicos. Considerando os avanços tecnológicos e a velocidade com que as produções científicas estão chegando ao ciberespaço, principalmente no ensino jurídico, onde a diversidade de entendimentos jurisprudenciais e doutrinários pode caminhar em lados opostos, é preciso conhecer bem as fontes e referências utilizadas para se fazer uso destes materiais. Nessa perspectiva, este estudo pretende encontrar fontes jurídicas em Recursos Educacionais Abertos, catalogando e identificando as licenças utilizadas e ressaltando os conflitos encontrados entre os direitos autorais e os recursos disponíveis, no sentido de disseminar essa informação no meio científico.
