  • Este texto trata da possibilidade do reconhecimento da eficácia positiva das normas programáticas, tese tradicionalmente rejeitada. Porém, entende-se cabível que estas normas produzam eficácia positiva e isto já vem mesmo ocorrendo, o que demanda uma revisão doutrinária.Palavras-chave: Norma programática; eficácia jurídica; eficácia positiva. Abstract: This text deals with the possibility of the recognition that effectiveness of programmatic norms can be positive, which is a theory that is traditionally rejected. However, I understand that it is possible that these norms can have positive effectiveness, and that this is actually already happening, what we need is a revision of our current way of thinking on this subject.Keywords: Programmatic norm; legal effect; positive effect.
