    This research investigates the current stage of the theory of quantum law in the face of Jürgen Habermas's post-metaphysical philosophical thinking and, in this sense, seeks to as-certain whether the referred theory, which presents itself as a perspective of natural law, can materialize as a metaphysical theory of law. In order to try this problem, the work presents three sections, the first being a presentationof the theory of quantum law and its philosophical foun-dation, the second section an approach to the post-metaphysical thought of Jürgen Habermas and, finally, the third section deals with to answer the question about the possibility of the quan-tum theoryof law being a metaphysical theory. The conclusion points to the fact that the quantum theory presents elements of a metaphysical character, as well as of a solipsistic nature, because defending the quantum law as a natural right, and also, sustaining that the judge creates a stand-ard for the concrete case from a choice in view of a dual perspective, ends up falling into a return to metaphysical thinking, long since been vanquished by the twentieth century theories of phi-losophy of language, among which, the discursive theory of law by Habermas

    A presente pesquisa investiga o atual estágio da teoria do direito quântico frente ao pensamento filosófico pós-metafísico de Jürgen Habermas e, nesse sentido, busca averiguar se a referida teoria, que se apresenta como sendo uma perspectiva de direito natural, pode se concre-tizar enquanto uma teoria metafísica do direito. No intuito de tentar enfrentar este problema, o trabalho apresenta três seções, sendo a primeira uma apresentação da teoria do direito quântico e seu fundamento filosófico, a segunda seção uma abordagem do pensamento pós-metafísico de Jürgen Habermas e, por fim, a terceira seção trata de responder a pergunta acerca da possibilidade de a teoria quântica do direito ser uma teoria metafísica. A conclusão aponta no sentido de que a teoria quântica apresenta elementos de caráter metafísicos, bem como de natureza solipsista, pois ao defender o direito quântico como direito natural, e ainda, ao sustentar que o juiz cria norma para o caso concreto a partir de uma escolha ante uma perspectiva dual, acaba caindo em um retorno ao pensamento metafísico, há tempo vencido pelas teorias da filosofia da linguagem do século XX, entre as quais, a teoria discursiva do direito de Habermas
